Accepting these terms
These Terms of Use ("Terms") apply to legacybehavior.com (the "website") and to our invitation-only family portal, both operated by Legacy Behavioral Collective ("we," "us," or "our"). By using the website or the portal, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use them.
General information, not clinical advice
The articles, blog posts, FAQs and other content on our website are general information about applied behavior analysis (ABA), parent coaching and related topics. They are not medical, clinical, psychological or behavioral advice, and they are not a substitute for an individualized evaluation by a qualified professional who knows your child. Every child is different, so please talk with a qualified provider before making decisions about care.
If you or your child are in danger or having an emergency, call 911 or go to the nearest emergency room. Do not use the website, email or WhatsApp for urgent needs.
No clinician-client relationship
Using the website, booking a free consultation, sending us an email or messaging us on WhatsApp does not create a clinician-client or other professional relationship with Legacy Behavioral Collective or any member of our team. Services begin only after you and Legacy Behavioral Collective sign a separate written service agreement. If these Terms conflict with that agreement, the agreement controls for the services it covers.
Consultations and scheduling
Consultations are booked through a Google Calendar appointment page embedded on our website, and your use of that tool is also subject to Google's terms and privacy policy. Appointment times depend on availability, and we may need to reschedule; if so, we will contact you using the details you provided. A consultation is a conversation about your family's needs and whether our services are a good fit. It is not an assessment or treatment.
For current clients, sessions booked through the family portal are drawn from the service hours on your account, as described in your service agreement.
Family portal accounts
The family portal is available by invitation only. Invitations are linked to a specific email address and expire after a set time. If you have a portal account, you agree to:
- use the portal only for your own family's services;
- keep your sign-in details private and not share your account;
- tell us promptly at info@legacybehavior.com if you think someone has used your account without permission; and
- treat the documents and information in the portal as confidential.
You are responsible for activity under your account. We may suspend or close portal access if services end, if we suspect misuse or a security problem, or if needed to protect a child or others.
Payments
Fees, service packages, cancellations and refunds are governed by your client service agreement. Payments made through the portal are processed by Square, and Square's terms and privacy policy apply to that processing. By submitting a payment, you authorize the charge shown at checkout. If you choose to save a card, it is stored by Square, not by us, and you can remove it from the portal at any time.
Acceptable use
When using the website or the portal, please do not:
- break any law or violate anyone's rights;
- try to access accounts, records or systems you are not authorized to use;
- interfere with the website's operation or security, or introduce malware;
- use bots, scrapers or other automated tools to collect content or data;
- impersonate another person or misrepresent your relationship with a child; or
- copy, sell or share other people's information.
Intellectual property
The website and its content, including text, articles, graphics, logos and design, belong to Legacy Behavioral Collective or its licensors and are protected by intellectual property laws. You may view and print our content and share links to it for personal, non-commercial use. Please do not copy, modify, republish or distribute our content, or use our name or logo, without our written permission.
Third-party services and links
Our website and portal rely on third-party services, including Google (Calendar scheduling, sign-in, Meet, Drive and Analytics), WhatsApp and Square. These services are run by other companies under their own terms and privacy policies, and we are not responsible for their content, availability or practices. Links to other websites are provided for convenience and do not mean we endorse them.
Disclaimers
We work to keep the website accurate and available, but it is provided "as is" and "as available." To the extent allowed by law, we do not promise that the website or portal will be uninterrupted, error-free or completely current, and we disclaim implied warranties such as merchantability and fitness for a particular purpose. Nothing in these Terms limits our obligations under your service agreement or under laws that cannot be waived.
Limitation of liability
To the extent allowed by law, Legacy Behavioral Collective will not be liable for indirect, incidental, special or consequential damages arising from your use of, or inability to use, the website or the portal. Where the law permits, our total liability for any claim relating to the website or portal is limited to one hundred U.S. dollars ($100). This section does not limit liability that cannot be limited by law, and it does not apply to the services we provide under a client service agreement, which are governed by that agreement.
Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute relating to these Terms, the website or the portal will be handled in the state or federal courts located in California, unless your service agreement or applicable law says otherwise.
Changes to these terms
We may update these Terms from time to time. When we do, we will post the new version on this page and change the "Last updated" date above. If you keep using the website or portal after an update, you accept the revised Terms.
